Introduction
Masahat Al-Mustaqbal is a licensed digital platform in Saudi Arabia offering real estate services such as short-term leasing, property listings, advertising spaces, and commercial storage, operating in full compliance with local laws and regulations.
"User(s)", “you” or "your" means the individual, organization who uses/ logs in /visits the website and/or benefits from any of the services or obtains any of the information published therein directly or indirectly, with or without registration.
This User Agreement should be read in conjunction with our Privacy Policy and any other documents referred to. By accessing, registering, or using the Masahat Platform, you acknowledge that you have read, understood, and expressly agreed to comply with the following:

- Masahat Privacy Policy
- All other operational, commercial, and governance policies published by Masahat or mandated by regulators
Definitions
Terms and Conditions: the Terms and Conditions that govern the relationship between the Operator and the User on using the Platform and its services, and all others service-specific Terms and Conditions of use.
Masahat Platform: (referred to as the Platform) is the collection of real estate services managed and operated by the Operator, being offered via a variety of websites and mobile applications, such as:

- Masahat mobile app on iOS and Android
Operator: is Masahat Al Mostaqbal Real Estate Company, a registered company in Saudi Arabia.
User: is a real person or a figurative person accessing the Platform services or using them, whether registered or unregistered (collectively referred to as Users).
General Provisions
By using the Platform, you agree and commit to the following:
- The Terms and Conditions are subject to all applicable laws and regulations in Saudi Arabia.
- If any provision of the Terms and Conditions becomes illegal, void, or unenforceable under any regulations, laws, or judicial rulings, the remaining provisions of the Terms and Conditions shall remain valid, enforceable, legal, and applicable under the law.
- The Platform endeavors, to the best of its ability, to provide information with utmost accuracy; however, occasional errors may occur. The Platform bears no responsibility for any inaccuracies in the information it contains
- You accept the Platform Terms and Conditions.
- You accept the Terms and Conditions related to any service you use through the Platform.
Use, Licensing and Restrictions
All material published on the Website including advertisements, data, text, video, still images, sound or other material that we have allowed you to log in is for your information and use of the Website only, and you may not do any of the following:
• Modify and copy materials.
• Use the materials for any private commercial purpose outside the Website.
• Remove any copyright or other proprietary notations from the materials.
• Transfer the material to another person or re-publish it on any other website.
When you enter the website and/or use any of the services on it, you represent and undertake not to do any of the following:
• Sharing, uploading or publishing any content that is misleading, deceptive, incorrect, or inconsistent with the purposes of the website, or obscene, or defamatory.
• Using or browsing the website in any way that would violate the laws, provisions and rules in force in the Kingdom of Saudi Arabia.
• Using or logging in the Website in any way that is unlawful or fraudulent or has an unlawful or fraudulent purpose or effect.
• Sending or attempting to transmit any computer virus, defect or other destructive material.
• Uploading, posting, broadcasting any information through the Website that may be harmful, threatening, immoral, harassing, obscene, slanderous, hateful, racially, ethnically, or otherwise discriminatory Legal in other respects.
• Sending spam, chain letters, content, spam, surveys or other group messages.
• Violating any person's rights, including copyright, trade secret, right to privacy, or any other intellectual property or proprietary right.
• Publishing, requesting or sharing any information related to third parties without their written consent.
• Using any electronic program, means or device to interfere or attempt to interfere electronically or manually with the operation or functionality of the website.
• Circumventing the laws, policies and regulations of the website or any rights related to a third party.
• Copying or republishing any content on other websites.
• Collecting information about website users for private purposes.
• Use the Website for any private commercial or business purposes unless we expressly agree in writing.
The user agrees and authorizes The Platform to save any data or information. The Platform also has the right to view and review them, monitor private messages and ensure their compliance with these restrictions and terms of use. The Platform reserves the right to delete any Content and/or suspend or terminate any User's membership without giving reasons.
Acceptable Use
By using the Platform, you acknowledge and commit to the following:
• You acknowledge and guarantee your legal capacity to accept the Terms and Conditions in accordance with all terms and conditions stated herein.
• You shall use the Platform in your personal capacity or on behalf of a person you are authorized to represent on the Platform (including, but not limited to, through power of attorney or employment). You may not use the Platform on behalf of any person you are not authorized to represent.
• You are responsible for the accuracy of all information entered into the Platform, whether related to your user data or submitted as content for participation or advertisement on the Platform.
• You shall not share any information that you do not have the right to publish or distribute.
• You shall not copy any content from the Platform and republish it on other sites without the content owner's consent.
• You are responsible for verifying and confirming the details published on the Platform and ensuring its accuracy. You are also responsible for consulting a technical expert or seeking legal advice before committing to any transaction, and for ensuring you act in good faith toward all other parties.
• You shall pay all fees due for Platform services when they become payable.
• You are responsible for complying with all applicable governmental requirements and for obtaining all necessary licenses to benefit from the Platform's services.
• You must not harm, defraud, lie to, or deceive any other User on the Platform.
• You must not use any means (including but not limited to: attempting to mask your identity via VPN or proxy software) to violate the Terms and Conditions, circumvent preventive measures imposed by the Platform for violations, gain unauthorized access to Platform content, or collect and harvest data or information relating to the Platform or its Users for any purpose or to republish it without authorization.
• You must not engage in political discussions, address public figures, or post unrelated discussions that are not connected to the services provided on the Platform.
• You must not infringe upon copyrights, trademarks, patents, publicity rights, database rights, or any other proprietary or intellectual property rights owned or licensed by the Platform.
• You must not impersonate the Platform, its representative, or an employee, nor claim any affiliation with the Platform within or outside the Platform unless you have formal authorization.
• You agree to indemnify and hold the Platform harmless against any and all liabilities, losses, claims, expenses (including legal fees), and damages (whether direct or indirect) arising from claims resulting from your misuse of the Platform, including but not limited to claims that are proven true and constitute a violation by you of the Terms and Conditions.
• You bear full legal and criminal liability for any breach of the Terms and Conditions committed by you.
Limitation of Liability
By using the Platform, you understand and agree to the following:
• The Platform provides no warranties and assumes no responsibility in the event that a user violates the Terms and Conditions. It bears no liability for any risks, damages, consequences, losses incurred by the User or any other party.
• The Platform makes no guarantees and assumes no responsibility for the accuracy, completeness, or correctness of any information contained in content published by Users on the Platform, nor for its compliance with applicable laws and regulations. Users are solely responsible for verifying the accuracy of the content before engaging in any transaction.
• Under no circumstances shall the platform be held liable for any damages (including, but not limited to, compensation for data loss, loss of profits, or business interruption) resulting from the use or inability to use the content and materials on the Platform.
The Platform shall not be held liable for any loss or damage arising from or related to the following:
a) Any malfunction due to software issues, internet errors, unavailability, or any other reasons beyond our reasonable control.
b) Any loss of your password or account due to power outage, system error, shutdown, or issues with your computer or account.
c) Any direct, consequential, special, punitive, or incidental losses or damages, including costs, expenses, loss of profits, business losses, loss of goodwill, damage to reputation, loss or corruption of data.
• The Platform assumes no liability or compensation obligation in cases where the User engages in any technical action without exercising due accuracy or integrity (including, but not limited to, phishing links, spoofed data, or online fraud). Users must take due diligence in all their platform interactions to ensure their safety.
• The Platform is not responsible for any loss or damage caused by viruses, denial-of-service attacks, or other technologically harmful material that may infect your devices, software, data, or other property as a result of your use of the Platform or downloading any content from it or from any linked site.
Preventive Measures
To improve the level and quality of services provided to Users of the Platform, and pursuant to your acceptance of the Terms and Conditions, you agree and grant the Platform the right to take any of the following actions without prior notice if it determines that you have breached the Terms and Conditions:
a) Suspend your membership and temporarily or permanently ban you from using all or any of the Platform’s services, while retaining the right not to compensate you for any prepaid services.
b) Delete all or any of the materials or content you have published on the Platform.
c) Report on your activities to the relevant authorities.
d) Take any other legal action against you.
Intellectual Property Rights
All intellectual property assets related to the Platform—including but not limited to software code, user interface, structure, layout, branding elements, databases, designs, images, and multimedia content—are the sole and exclusive property of Masahat or its licensors and are protected under applicable Saudi intellectual property laws.
No user is permitted to reproduce, republish, modify, distribute, exploit, or transmit any proprietary content without obtaining prior written consent from Masahat. Any infringement of these rights will subject the violator to civil and/or criminal liability under law.
Property Listings and Advertisements
The Platform allows verified property owners, licensed brokers, and authorized developers to publish real estate listings and advertisements. While Masahat applies internal moderation and verification tools, it does not guarantee the completeness, accuracy, or legal status of any listing content. Users bear full responsibility for conducting independent due diligence before entering into any commercial transaction.
Amendment of the Agreement
By using the Platform, you acknowledge and agree to the following:
• The Platform has the right to update, change, or amend the Terms and Conditions at any time and without prior notice.
• Once any modifications to the Terms and Conditions are published on the designated pages of the Platform, they shall become effective and binding on both the Platform Operator and the User for any transactions as of the date of publication.
• You may not claim lack of knowledge or ignorance of the Terms and Conditions, and such a claim will not be accepted as a defense in enforcing the agreement between the Platform and the User or in relation to any third party.
Commission and Service Fees
Masahat may charge platform service fees or brokerage commissions for real estate transactions conducted or facilitated via the Platform, in accordance with applicable REGA regulations. All commissions will be disclosed prior to finalizing a transaction and are subject to applicable VAT or regulatory fees, where applicable.
Third-Party Services and Links
The Platform may contain links or access points to external third-party services (e.g., payment gateways, KYC platforms, or mapping tools). Such services are not under the control of Masahat, and the Company disclaims any responsibility for the accuracy, reliability, or compliance of external content. Use of these services is at the user’s sole risk and subject to their independent terms and policies.
Data Protection and Privacy
Your access and use of the Platform are subject to our Privacy Policy, which governs how your data is collected, processed, stored, and protected in compliance with REGA guidelines and Saudi data protection laws. Masahat commits to maintaining data confidentiality, integrity, and lawful processing practices.
Disclaimer and Limitation of Liability
The Platform and its services are provided on an "as-is" and "as-available" basis. While Masahat endeavors to maintain a secure and uninterrupted service, we do not guarantee error-free operation, nor do we warrant the Platform will be free from viruses or technical vulnerabilities.
Masahat shall not be liable for any direct, indirect, incidental, or consequential damages arising out of or related to:
• Platform access interruptions
• Inaccurate listing content
• Unauthorized use of user accounts
• Use of third-party services
Account Suspension and Termination
Masahat reserves the right, at its sole discretion, to suspend or permanently terminate any user account or access to the Platform in cases of
• Policy violations
• Regulatory non-compliance
• Security threats or misuse
No prior notice is required in the event of severe or repeated
Governing Law and Jurisdiction
These Terms of Use and any related disputes shall be governed exclusively by the laws of the Kingdom of Saudi Arabia. The competent courts in Riyadh shall have exclusive jurisdiction to adjudicate any claim, dispute, or proceeding arising under or related to these Terms.
Modifications and Updates
Masahat may amend these Terms of Use at any time in response to legal, regulatory, or operational changes. Updated versions will be posted on the Platform and will become effective upon publication. Continued use of the Platform constitutes acceptance of the modified terms.
