Intellectual Property Rights Policy

Article I: Preamble

This Intellectual Property Rights Policy ("Policy") is issued by Masahat Al-Mustaqbal Real Estate Company (“Masahat” or the “Platform”) in its capacity as the operator and owner of the digital real estate platform known as "Masahat". This Policy outlines the legal framework governing the protection, use, and enforcement of intellectual property rights associated with the Platform, including but not limited to content originating from Masahat, its users, service providers, and third parties. The provisions herein are aligned with the applicable intellectual property laws of the Kingdom of Saudi Arabia, including but not limited to the Copyright Law, Trademark Law, Patent Law, and regulations issued by the Real Estate General Authority (“REGA”) and other relevant regulatory authorities.

Article II: Intellectual Property Owned by Masahat

  1. All proprietary materials and content hosted or displayed on the Platform—including, without limitation, source code, software architecture, user interface elements, design layouts, images, videos, data structures, trademarks, trade names, logos, domain names, documentation, written content, and associated technologies—are the exclusive property of Masahat and are protected under applicable local and international intellectual property laws.
  2. No part of the Platform’s content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, mirrored, or otherwise exploited for any commercial or public purpose without the prior written consent of Masahat. Any unauthorized use may constitute a violation of applicable laws and shall entitle Masahat to seek all available legal remedies.
  3. “Masahat” reserves all rights, whether expressly granted or not, and shall take all necessary legal and technical actions against any infringement or misuse, including digital infringement, misappropriation, or unauthorized commercial use of its intellectual property.

Article III: User-Generated Content

  1. By submitting any content to the Platform, including but not limited to text, images, logos, video files, location data, maps, or any other form of media ("User Content"), the user affirms that they either own such content or possess the necessary licenses, permissions, and rights to upload and share it via the Platform. Users assume full and exclusive legal liability for any content they submit.
  2. The user agrees not to upload or distribute any content that violates third-party intellectual property rights, including copyrights, trademarks, patents, industrial designs, trade secrets, or other proprietary rights.
  3. “Masahat” reserves the unilateral right to remove, block, or disable access to any User Content that it deems, at its sole discretion, to be infringing, misleading, fraudulent, or otherwise in violation of this Policy or applicable laws, without prior notice.

Article IV: Enforcement and Dispute Resolution

  1. If a user is found to have engaged in activities that constitute an infringement of intellectual property rights, “Masahat” may, without limitation and at its sole discretion, take the following actions:
    a)    Immediately remove the infringing content.
    b)    Suspend, restrict, or permanently terminate user’s account.
    c)    Refer the matter to relevant legal or regulatory authorities for further action.
    d)    Pursue civil or criminal remedies under applicable law.
  2. “Masahat” will receive and process intellectual property infringement claims or complaints through its designated official channels. All claims shall be reviewed in a timely manner and addressed in accordance with documented procedures that ensure transparency, due process, and compliance with applicable law.

Article V: License to “Masahat”

By publishing or uploading User Content on the Platform, the user hereby grants to “Masahat” a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, and sublicensable license to use, reproduce, adapt, distribute, publicly perform, and display such content for the purposes of operating, improving, and promoting the Platform and its services.

Article VI: Amendments to the Policy

“Masahat” reserves the exclusive right to amend, modify, or update this Policy at any time. Such amendments shall become effective upon publication on the Platform or upon notification to the user via email or other official communication channels. Continued use of the Platform following such changes constitutes acceptance of the amended Policy.
